TOS AND POLICIES

Please read through entirely before contacting me about commissions.

These terms of service are subject to change. By commissioning me, you acknowledge that you have read and will be held to these terms.

I reserve the right to cancel at any time and for any reason. A statement will be provided explaining why I have chosen to cancel the commission and issue a refund based on my refund policy.

~~~DO AND DO NOT~~~

~~~OOAK WORK~~~

Each and every physical commission I make is 100% unique and original (One of a Kind [OOAK]). I will never make duplicates or reproductions of anything I’ve previously made. The only exception is for repairing or restoring broken/destroyed work for the original client. 

~~~ESTIMATED TIME FRAME~~~

Making art and fursuits is my primary job. But sometimes motivation and outside forces can greatly affect and delay projects. Regardless, I will always try to complete each commission as timely as possible. If a work in progress (WIP) update is not provided within 6 months after being paid for, the client may request a refund. If a refund is requested, the amount will be determined based on my refund policy.

~ ROUGH TIMEFRAMES ~

Illustrations: 2 - 4 weeks
Badges: 1 week
VR Models: 3 - 5 days
Fursuit Parts: 5 - 9 weeks
Fullsuits: 15 - 30 weeks
Plushies: 7 - 15 weeks

~~~AI Art Policy~~~

I will not accept any AI “art” as any form of reference. My work, and my commissioned work is also forbidden from being used to train AI in any way, shape, or form. Doing so WILL result in an immediate and permanent blacklist from all my work. I do not, and will never support the use of AI art.

~~~REFUND POLICY~~~

Refunds will be determined based on the amount of completed work versus the amount of work remaining to complete.

If you need to request a refund for your commission, please contact me via email (artbyneffertity@gmail.com).

If your commission is not completed within 6 months of payment, you are eligible for a refund. All physical commissions (Ex. Fursuits, Sculptures, Badges, Plushies) have a non-refundable initial payment to cover material costs. This amount will be clearly marked on the initial invoice. Refunds will only be issued via PayPal refund invoices. Payments made via other services will not qualify for refunds. Refunds will always be case-by-case.

 ~~~PRICE QUOTE POLICY~~~

All quotes provided are for 1 individual item. When contacting me for a commission quote, you are required to provide the following information. Failure to do so will result in the contact email being disregarded:

A digital reference sheet or clear digital image of your character. (NO SHADING!)

Proof you have read all my TOS. (there’s a keyword hidden in it")

Proof of character ownership. (Design layers, adopt receipts, toyhouse account, etc)

Basic info: (what you want done, level of suit, extra features, etc)

The first item in your price quote is free of charge. Any following quotes will incur a $5 charge per quote.

 ~~~VR MODEL REPAINTS~~~

PLEASE NOTE: I DO NOT OFFER CUSTOM SCULPTED MODELS (yet)!

Prices for model retextures range from $35 to $350. You can always view samples of my work and quality on the VR Repaint Page. BOTH parties are REQUIRED to own all the base models and assets used for the commission. Proof of purchase for said assets IS REQUIRED. (please provide your receipt for the assets with your contact email shown on the receipt)

Average turnaround time is roughly 3 - 5 days once started, for most retexture projects.

Completed retextures are provided to the client via a zip folder that contains the textures, unity package file, and a high quality render to use for thumbnails or previews.

 ~~~PAYMENT PLANS~~~

Payment plans are accepted.

You (the client) agree to pay 35% of the total cost of the commission as a down payment before any work has begun. This portion is non-refundable. It covers the material costs that will be used in the commission. Any payments that are not the initial payment quality to be refunded. Please refer to the refund policy listed above for more information.

After the initial down payment is received, the remaining payments are then divided into equal amounts based on how many months the client would like to take to fully pay off their commission (maximum of 6 months).

What about premades?

I do offer payment plans for premades, however they work slightly different.
A premade payment plan requires 50% of the total cost as the downpayment. You (the buyer) then have a total of 4 months to pay the remaining balance. If this payment plan is failed to be met, the sale is considered negligent and 30% of what’s been paid will be refunded. You (the buyer) will also be blacklisted from future premade sales for failure to make payment.

 ~~~UNDERAGE MINOR POLICY~~~

Physical commissions (fursuits, badges, plushies, sculptures) will NOT be accepted from clients under the age of 18.

By commissioning me, you acknowledge that you are AT LEAST 18 YEARS OLD. In the event that I take a commission for a minor, ALL COMMUNICATION WILL BE DIRECTED TO THEIR PARENT/GUARDIAN. Commissions for minors must provide separate contact information for the minor as well as the parent/guardian.

 ~~~NSFW Content POLICY~~~

I WILL NOT MAKE ANY FURSUITS OR PLUSHIES WITH ANY NSFW CONTENT OR MATERIAL.

While you are welcome to do whatever you want with the products you purchase from me, by reading these TOS you agree that you forfeit any warrenties and future repairs I may offer to other clients. I will not work on suits or plushies that have been used in any form of adult activity.
